Kaplan was stopped by law enforcement on Sunset Boulevard in Hollywood, California. Kaplan unwisely agreed to perform the roadside gymnastics referred to as the Standardized Field Sobriety Tests (SFSTs).
As you can see on the video, the Officer administering the walk and turn failed to do so properly. The administrator of the walk and turn should advise "When you turn, keep the front foot on the line, and turn by taking a series of small steps with the other foot, like this." (Demonstrate) The officer merely turned around. When Kaplan mimicked his faulty instruction, Kaplan stepped off the line. Kaplan's misstep must be attributed to the incorrect demonstration and instruction.
As the instructions state: "This validation applies ONLY when the tests are adminstered in the prescribed, standardized manner . . . If any one of the standardized field sobriety test elements is changed, the validity is compromised. " Obviously incorrect administration compromised the test validity.
